<p>Nine Eurozone members want the Danish Presidency of the EU to speed up its work on a directive on a <a class="zem_slink" title="Financial transaction tax" rel="wikipedia" href="http://en.wikipedia.org/wiki/Financial_transaction_tax">Financial Transaction Tax</a> (FTT). While there is much opposition within the Eurozone and wider EU to such a tax, the nine countries intend to use the community method to allow them to use the EU institutions to set up and administer the tax and allow other countries to join while not holding them back.</p>
<p>The nine countries are:</p>

<p>Taxation remains an unanimous decision at the Council of Ministers under the Treaty of Lisbon, so even if one country opposes there will not be an EU wide tax on financial transactions.</p>

		<description><![CDATA[John Dali, the European Commissioner for Health and Consumer Policy, has stated that a blanked ban on Gay and Bisexual Men giving blood is against EU law. In an answer to Glenis Willmott (S&#38;D) and Michael Cashman (S&#38;D) he explained that EU law warranted the deferral of those “at high risk of acquiring severe infectious diseases” due to their “sexual behaviour”. Mr Dalli underlined that “‘sexual behaviour’ is not identical with ‘sexual orientation’”. The Commission also noted that when implementing EU law, Member States must not discriminate on the basis of sexual orientation. This means a blanket ban on all gay and bisexual men would be illegal under EU law. According to the European Parliaments Intergroup on LGBT Rights, National Authorities often cite a 2004 Directive on technical requirements for blood and blood components to justify the ban. Most member states have a de facto ban on gay men from giving blood and this includes Ireland. <p>John Dali, the European Commissioner for Health and Consumer Policy, has stated that a blanked ban on Gay and Bisexual Men giving blood is against EU law.</p>
<p>In an answer to<a href="http://www.europarl.europa.eu/sides/getDoc.do?pubRef=-//EP//TEXT+WQ+E-2011-006484+0+DOC+XML+V0//EN&amp;language=EN" target="_blank"> Glenis Willmott (S&amp;D) and Michael Cashman (S&amp;D) </a>he explained that EU law warranted the deferral of those “at high risk of acquiring severe infectious diseases” due to their “sexual behaviour”. Mr Dalli underlined that “‘sexual behaviour’ is not identical with ‘sexual orientation’”.</p>
<p>The Commission also noted that when implementing EU law, Member States must not discriminate on the basis of sexual orientation. This means a blanket ban on all gay and bisexual men would be illegal under EU law.</p>
<p>According to the <a href="http://www.lgbt-ep.eu" target="_blank">European Parliaments Intergroup on LGBT Rights</a>, National Authorities often cite a <a href="http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=CELEX:32004L0033:EN:HTML" target="_blank">2004 Directive on technical requirements for blood and blood components to justify the ban.</a> Most member states have a de facto ban on gay men from giving blood and this includes Ireland.</p>
<p>Michael Cashman MEP, Co-President of the European Parliament’s Intergroup on LGBT Rights, said the Commission’s answer “makes a lot of sense. Commissioner John Dalli reminds Member States that it is individuals who are at risk—not groups. Being gay or bisexual cannot automatically pose a threat to public health; but risky sexual behaviour in men or women, gay or straight, is a real risk. I hope <a href="http://www.bbc.co.uk/news/health-14824310">the British government’s announcement</a> later today will prefer scientific evidence to prejudice.”</p>
<p>Further commenting the Commission’s answer, Sirpa Pietikäinen MEP, Vice-President of the LGBT Intergroup and Member of the <a href="http://www.europarl.europa.eu/activities/committees/presCom.do?language=EN&amp;body=ENVI">Committee on Public Health</a> added: “It is our highest priority to look after public health, and thus take care of the quality of donated blood. But health ministers must bear in mind that sexual orientation, ethnic background and other identity traits are fully irrelevant to a person’s health. Denying blood donation from these groups is discriminatory and goes fully against logic.”</p>

The majroity of legislations, rules and payments relating to Agriculture comes from the European Union through the Common Agriculture Policy. This is where Simon will do an excellent job as Agriculture Minister. Why? Easy, Its because he knows how the Europe Union works. Simon was an MEP from 2004 to 2007. He was a spokesperson for the European Peoples Party. He has experience with dealling with these issues in Europe. Also with CAP reform being a major issue, have a Minister with intimate knolwdege of how laws are passed by the EU and with contacts outside of the various Government, should mean that he may have a bit of sway in the EU. This should help her to explain Ireland&#8217;s poistion to friendly ears and hopefullly get us a good deal. Its also more likely that she will turn up to more meetings than her preprocessor.<br />
Here is hoping that these appointements will bear fruits for Ireland.</p>

<p>This is an interesting idea from the ELDR. It will do two things for them. One create a possible cash flow and secondly create a a grouping that will work for them outside of the framework of the national parties. I wonder will other European parties follow their lead.</p>

<p>European Movement Ireland have launched a<a href="http://www.europeanmovement.ie/fileadmin/files_emireland/downloads/Uploads_2011/CI_Campaign_Report.pdf" target="_blank"> report</a> on the campaign that they undertook in relation to the European Citizen&#8217;s Initiative. As part of this a poll was undertaken in Cork, Galway, Dublin North and Dublin South on May 7th 2010.</p>

The idea of this boycott came after Belgian MEP Louis Michel, co-chair of the EU-ACP assembly, called a special meeting after receiving a letter from Luxembourg colleague Charles Goerens MEP, who wrote that the law &#8221;violates democratic principles recognised by EU member states&#8221;. The ACP-EU Joint Parliamentary Assembly brings together MEPs and elected representatives from the African, Caribbean and Pacific (ACP) countries that have signed the Cotonou Agreement. MPs from the ACP states meet their European counterparts for two plenary sessions a year, focusing on democracy and human rights. The 2011 meetings are scheduled for 16-18 May in Budapest and 21-23 November in Sierra Leone. 			<content:encoded><![CDATA[<p><a href="http://stephenspillane.com/blog/wp-content/uploads/2011/01/EUUK.jpg"><img class="alignright size-full wp-image-3436" title="EUUK" src="http://stephenspillane.com/blog/wp-content/uploads/2011/01/EUUK.jpg" alt="" width="275" height="183" /></a>Today the House of Commons will consider as a Committee of the whole house, the <a href="http://www.publications.parliament.uk/pa/cm201011/cmbills/106/11106.1-7.html" target="_blank">European Union Bill</a>. This will mean that in future the United Kingdom will have to hold a referendum on future treaties which amend the Treaty on European Union and the Treaty on the Function of the European Union</p>
<p>Under the Bill the UK will have to hold a referendum if the treaty meets one of these conditions:</p>
<blockquote><p>(a) the extension of the objectives of the EU as set out in Article 3 of TEU;</p>
<p>(b) the conferring on the EU of a new exclusive competence;</p>
<p>(c) the extension of an exclusive competence of the EU;</p>
<p>(d) the conferring on the EU of a new competence shared with the member  States;</p>
<p>(e) the extension of any competence of the EU that is shared with the member States;</p>
<p>(f) the extension of the competence of the EU in relation to—</p>
<p>(i) the co-ordination of economic and employment policies, or</p>
<p>(ii) common foreign and security policy;</p>
<p>(g) the conferring on the EU of a new competence to carry out actions to support, co-ordinate or supplement the actions of member States;</p>
<p>(h) the extension of a supporting, co-ordinating or supplementing competence of the EU;</p>
<p>(i) the conferring on an EU institution or body of power to impose a requirement or obligation on the United Kingdom, or the removal of any limitation on any such power of an EU institution or body;</p>
<p>(j) the conferring on an EU institution or body of new or extended power to impose sanctions on the United Kingdom;</p>
<p>(k) any amendment of a provision listed in Schedule 1 that removes a requirement that anything should be done unanimously, by consensusor by common accord;</p>
<p>(l) any amendment of Article 31(2) of TEU (decisions relating to common foreign and security policy to which qualified majority voting applies) that removes or amends the provision enabling a member of the Council to oppose the adoption of a decision to be taken by qualified majority voting;</p>
<p>(m) any amendment of any of the provisions specified in subsection (3) that removes or amends the provision enabling a member of the Council, in relation to a draft legislative act, to ensure the suspension of the ordinary legislative procedure</p></blockquote>
<p>It is important to note that if the treaty does any of the following, a Referendum is not needed and an Act of Parliament would suffice,</p>
<blockquote><p>(a) the codification of practice under TEU or TFEU in relation to the previous exercise of an existing competence;<br />
(b) the making of any provision that applies only to member States other than the United Kingdom;<br />
(c) in the case of a treaty, the accession of a new member State.<br />
 </p></blockquote>
<p>It is an interesting idea from the Coalition Government. Maybe it is something we should consider doing here as it would remove some of the confusion that it exists in relation to the Crotty Judgement and would set out when we actually do need to hold a referendum on European Treaties.</p>
